Give them credit for nice neat wiring, but was this a new item being sold by a legitimate supplier?

A new item, from somebody registered as a trader? If so they were clearly breaking the law. Though ebay and Trading Standards enforcement is very weak. If by a genuinely private seller, then it's unfortunate rather than illegal.

Not a private seller, quite a big one on eBay. Should I contact trading standards?

You could contact TS but I doubt it will do any good. TS are far too overstretched to deall with any but the most appalling cases. You may have more luck with ebay's own enforcement process but again I wish you luck.

It looks like the orange bit is supposed to hinge down over the terminals.
If it is true and there is a way of fixing it down securely it is not so bad. |
