Our club had a talk from a representative from the RSGB which was a great help. He reckoned that in the main most amateurs will easily comply. The RSGB calculator is going through a revamp and they are adding in more antennas, heights and other factors that will make the task for us clearer and easier.
Foundation and Intermediate licence holders are less likely to have issues than full licence holders using their full licence power, yagis and insufficient height or indeed inverted V dipoles with the ends too low.
It to me seems like common sense needs to prevail.
A couple of things to remember is to take into account the duty cycle between transmit and receive, if you are borderline not to transmit if members of the public are around and take sensible precautions.
