Blinding NO. Its down to the driver to drive correctly and ensure that the headlamps are properly adjusted. It is important that the bulb filament is in the correct place relative to the reflector, not necessarily at the focal point, to give shape to the beam.
I have never to my knowledge blinded a driver either coming towards me or in front of me.
I would agree that some modern lens constructions do scatter more light vertically than the lamps of old. but now at least you can see ahead and not what you are going to hit in half a second. Vertical scatter cannot blind another driver, unless he is stood in front of the car.
I used to drive through the night at high speed on some winding lanes in winter ice and snow chasing rally cars for service stops. It is basic good driving to be aware of any oncoming vehicle. With efficient headlamps it is not necessary to always be on high beam or have a barrage of spot lamps.
Digressing, its not the guys on full beam that annoy but the silly billies with the fog lamps on as well, er, also illegal methinks, unless it is foggy or snowing.
As for LEDs can they be correctly focused? they are not a point source of light.
